MEMO CIRCULAR NO. 004.11

TO : All Water Districts

SUBJECT : Implication of Executive Order No. 24 to the Grant of the Year-End
Financial Assistance and P5,000.00 Cash Gift for CY 2010 to Members of Water District Board of Directors


DATE : 15 February 2011


Executive Order No; 24, issued by the Office of the President on 10 February
2011, under Section 5, thereof, provides:

"Section 5. Local Water Districts -- Members of the Board of'
Directors/Trustees of Local Water Districts shali likewise be subject to the policies and principles set forth herein. Separate rules pertaining to classification and compensation of members of the Board of Directors/Trustees of Local Water Districts shall be issued for the purpose."

It will be noted that the undersigned had issued Memorandum Circular No. 015-10, dated 07 December 2010 to all Water Districts relative to the suspension of the grant of the Year-End Financial Assistance and P5,000.00 Cash Gift to the Members of the WD Board of Directors, pursuant to Executive Order No. 7, dated 08 September 2010. The suspension was further extended until January 31, 2011 pursuant to Executive Order No. 19, dated 30 December 2010.

The grant of the Year-End Financial Assistance and the P5,000.00 Cash Gift for CY 2010 to the members of the WD Board of Directors is not without any legal basis. LWUA authorized such benefit pursuant to R.A. No. 9286, amending Sec. 13 of P.D. 198, as amended, which states:

"Section 13. Compensation. - Each director shell receive per
diem to be determined by the Board, for each meeting of the Board actually attended by him, but no director shall receive per diems in any
given month in excess of the equivalent of the total per diem of four meetings in any given month.

Any per diem in excess of One Hundred Fifty Pesos (P150.00) shall be subject to the approval of the Administration. In addition thereto, each director shall receive allowances and benefits as the Board may prescribe, subject to the approval of the Administration."

In view of the explicit pronouncement under Section 5 of E.O. No. 24 that
"separate rules" shall be issued for the purpose, and in the meantime that such rules are not yet in place, it is therefore implied that the CY 2010 Year-End Financial Assistance and the P5,000.00 cash gift, authorized pursuant to LWUA Board Resolution No. 239, s. 2005, implementing R.A. No. 9286 may now be released.

SUBJECT: Nationwide World Water Day Celebration on March 22, 2011
              Theme - Water for Cities: Responding to the Urban Challenge

The United Nations General Assembly designated March 22 of each year as
World Water Day. This world day for water was observed starting in 1993 in
conformity with the recommendations of the UN Conference on Environment and Development. Countries around the globe were invited to devote the Day to implement the UN recommendations and set up concrete activities as deemed appropriate in the local context and setting.

The objective of World Water Day 2011 is to focus international attention on
the impact of rapid urban population growth, industrialization and uncertainties caused by climate change, conflicts and natural disasters on urban water systems.

On March 21-25, LWUA will hold several activities in a weeklong celebration
of this important occasion. (click here for program)

As part of the global water community, we therefore enjoin all water districts
to participate in this worthwhile endeavor. Other activities that may be considered are display of posters and billboards, art and photo exhibit, motorcade, tree planting, coastal clean-up, educational tours, and seminars/symposia.

Kindly document all your activities, which will be forwarded to the UN
Headquarters so that the Phillippines thru LWUA and the Water Districts will be counted as one of the countries which participated in this worldwide celebration.

To: ALL OPERATIONAL WATER DISTRICTS IN VISAYAS

Subject: INVITATION TO PLANNING WORKSHOP ON WATERSHED MANAGEMENT

The Local Water Utilities Administration, with co-hosts Dumaguete City Water District and the Negros Oriental Water Districts Association, will hold a two-day Workshop on Planning Watershed Management Projects for Water Districts in Dumaguete City. Dates of the Workshop will either be March 22 to 23 or 23 to 24, 2011 (actual dates to be finalized depending on arranged venue facility).

The Workshop shall focus on project formulation and preparation and accessing LWUA financing assistance. We are inviting operational Water Districts in the Visayas regions and we are looking to have WD officials and/or personnel who are involved in watershed management concerns to participate at the workshop. Workshop program details are still being worked out and when these and other details together with venue and dates are finalized, such will be posted at the LWUA website (www.lwua.gov.ph), accordingly.

LWUA is to shoulder venue and food expenses at the Workshop. However, participants will have to cover their own respective expenses for travel to and from Dumaguete City, accommodations thereat, plus food expenses outside of the workshop program.

MEMORANDUM CIRCULAR NO. 002-11

TO: ALL WATER DISTRICTS

SUBJECT: LA NIÑA ADVISORY

In the latest Climate Forum held February 2, 2011, the Philippine Atmospheric, Geophysical and Astronomic Services Administration (PAGASA) has confirmed the existence of a moderate to strong La Niña episode in the Central Equatorial Pacific region which includes the Philippines. Contrast to the El Nino phenomenon which is characterized by long dry spells, the La Niña brings more and heavy torrential rains which have recently been causing wide-spread flash floods and landslides in countries such as the USA, Australia and even eastern parts of the central and southern Philippines.

Based on its own projection and those of reference international weather observatories, the PAGASA is predicting a shorter and rainy dry season and the early onset of the monsoon season (by the last week of April or early week of May) this year in the country particularly for the western regions and provinces of Luzon and the Visayas belonging to the Type 1 climate classification (with pronounced dry and wet season).

In view of this, all water districts are advised to immediately undertake appropriate preparatory measures and formulate emergency mitigation as well as response plans to:

1. Protect and safeguard from floods and landslides all natural water sources and resources such as watershed areas, springs, wells and river weirs/dams as well as vital facilities and installations such as spring intake boxes, filtration beds, pumping stations, water treatment plants, reservoirs, power sources and lines and transmission and distribution lines including vulnerable service connection lines;

2. Protect and safeguard vital office facilities and documents;

3. Ensure the continuity of basic potable water supply and services to the concessionaires even in the event of natural calamity and emergency;

4. Ensure the integrity of supplied water particularly along pipelines submerged in floodwater against contamination that may lead to outbreak of waterborne diseases;

5. Provide ready communication/coordination/assistance to national and local authorities in relief operations; and

6. Conduct the necessary information and awareness campaigns in their respective areas.

MEMORANDUM CIRCULAR NO. 001-11

TO: ALL WATER DISTRICTS

SUBJECT: CLASSIFICATION OF COMMERCIAL CONNECTIONS

This is to uphold Chapter III Section 4 on the Classification of Service Connections of the LWUA Water Rates and Related Practices Manual (p.11) which classifies Government institutions as residential connection with a Conversion Factor of 1.0 (base rate) as currently adopted by LWUA in its approval of water rates.

Any other Section or provision in the Manual that may be construed to reclassify government institutions otherwisde is therefore negated.

MEMORANDUM CIRCULAR NO. 014-10

TO: ALL WATER DISTRICTS

SUBJECT: PERFORMANCE AUDIT OF WATER METERS


There is a need for Water Districts to reduce the Non-Revenue Water (NRW) in
order to enhance its operational efficiency and improve its financial viability.

All Water Districts are therefore enjoined to periodically conduct performance
audit of water meters being used by customers to ensure its accuracy.

Depending on the condition of operation, the water meters should be tested for its accuracy after five (5) years of utilization. Water meters showing errors of more than the following tolerance levels should be calibrated or replaced.

From Maximum Flow to Transitional Flow: ± 2%
From Minimum Flow to Transitional Flow: ± 5%

In view of the foregoing, all Water Districts are encouraged to allocate funds to
establish their own water meter testing facility.

SUBJECT: Suspension of Year-End Financial Assistance and P5,000.00 Cash Gift to Incumbent Members of Water District Board of Directors

Please be advised that the grant of Year-end Financial Assistance and P5,000.00 Cash Gift to incumbent members of the Water District Board of Directors, authorized under LWUA Board Resolution No. 239, s. 2005, is presently suspended in view of the issuance by His Excellency President Benigno S. Aquino III of Executive Order No. 7, dated 08 September 2010, Section 10 of which, states:

"Section 10: Suspension of All Allowances, Bonuses and Incentives for Members of the Board of Diretors/Trustees. - The grant of allowances, bonuses, incentives, and other perks to members of the board of directors/trustees of GOCCs and GFIs, except reasonable per diems, is hereby suspended until December 31, 2010, pending the issuance of new policies and guidelines on the compensation of these board members."

(NORMIN-NRMC) and the Cagayan de Oro City Water District (COCWD), will be holding a Workshop on Planning Watershed Management Projects for Water Districts on December 8 to 9, 2010 to be held in Cagayan de Oro City at the Chali Beach Resort & Conference Center. The workshop shall focus on project formulation and preparation and accessing LWUA financing assistance. We are inviting operational Water Districts in Mindanao and we are looking to have WD officials and/or personnel who are directly involved in watershed management concerns to participate at the workshop. LWUA will shoulder venue and food expenses at the Workshop. Travel expenses to and from Cagayan de Oro City and accommodations thereat shall be to the account of the Participant/s. MEMORANDUM CIRCULAR NO. 009-10

TO: ALL WATER DISTRICTS

SUBJECT: Directive Prohibiting the Association of the President's Name and Image in Government Programs and Projects

The Office of the President has issued a Memorandum dated 05 August 2010 directing all Heads of Government-Owned and-Controlled Corporations "to refrain from associating the President's personality and identity in their program and projects". Consequently, "tarpaulins, billboards and other propaganda materials bearing the President's name and image" shall not be put up for display to announce ongoing or completed programs and projects.

All WD Boards of Directors and WD General Managers shall therefore be expected to strictly implement the President's instructions, coursed through Secretary Julia Andrea R. Abad of the Presidential Management Staff.
