MEMORANDUM CIRCULAR NO. 015-12

TO: ALL WATER DISTRICTS

SUBJECT: Revised Guidelines on the Compensation of Water District
Directors and Other Benefits Pursuant to EO 65

 

In order to ensure uniform and clear implementation of the provisions of
Executive Order 65, revised guidelines on Water District Board per diems and
other benefits is hereby issued:

A. PER DIEMS

1. Each director shall receive a per diem corresponding to the category
of the water district for each meeting of the Board he/she actually
attended, but no director shall receive per diems in any given month
in excess of the equivalent of two (2) meetings.

2. The Board Chairperson is entitled to receive an additional amount
not exceeding twenty percent (20%) of the amount authorized for
the members of the Board for each meeting he/she actually
attended. This entitlement is not included in the annual cap under
Section 4 of EO65 and should be provided additional appropriation in
the WD budget.

3. The rate of per diems shall be based on the water district's category
as determined by LWUA in accordance with the Revised Local Water
District Manual on Categorization, Re-categorization and Other
Related Matters (LWD-MaCRO). Such per diems shall be equal to the
computed point rating multiplied by the factor assigned to the WD's
established category.

4. For Category A water districts, directors assigned to the working
committees under the Board of Directors shall receive per diems for
committee meetings actually attended not exceeding 60% of the
approved per diems for board meetings: Provided that, the
maximum amounts specified under Section 7 of EO 65 shall not be
exceeded regardless of the number of working committees created
and frequency of meetings held.

5. The maximum annual per diems prescribed under Section 4 of EO 65
shall become effective on the date of receipt of the WD's Certificate
of Category. Per diems paid for meetings held before the said
effectivity date shall not be deducted from the prescribed annual
ceiling.

B. REIMBURSABLE EXPENSES

1. Reimbursable expenses shall not be treated as a form of
compensation. Section 10 of EO 65 provides for the following
reimbursable expenses:

a. All Transportation expenses in going to and from place of
meetings;
b. Travel expenses during official travel;
c. Communication expenses; and
d. Meals during business meetings.

2. All necessarv expenses of the members or the Board in attending
board meetings and while discharging their official duties shall be
either paid directly or reimbursed by the water district.

3. The aggregate amount of all reimbursable expenses shall not exceed
twenty five percent (25%) of the actual per diems received for board
meetings.

4. Claim/s for reimbursement must be duly supported by official
receipt/s.

5. Reimbursement of expenses for official travel of members of the WD
Board of Directors outside of their official station shall be in
accordance with existing guidelines provided by EO No. 248 S. 1995,
as amended by EO 248-A S. 1995 and EO 298 S. 2004.

C. YEAR-END FINANCIAL ASSISTANCE AND P5,OOO CASH GIFT

This benefit is hereby suspended until such time that appropriate
clearance or approval from higher authority shall have been obtained.

D. PERFORMANCE-BASED INCENTIVES

Pursuant to Section 9 of EO 65, grant of this benefit is subject to a set of
performance criteria developed by LWUA, endorsed by GCG and subject to the
approval of the President.

E. APPLICABILITY

This Memorandum Circular supersedes lWUA Memorandum Circular No.
005-12 dated March 16, 2012.

MEMO CIRCULAR NO. 011-12


TO: ALL WATER DISTRICTS IN LAGUNA, CAVITE, BULACAN, PAMPANGA,
AND BATAAN

SUBJECT: CONSULTATIVE WORKSHOP ON SANITATION & WASTEWATER
MANAGEMENT FOR WDS - MANILA BAY

As you may already be aware, the Supreme Court has directed LWUA and concerned WDs in the provinces of Laguna, Cavite, Bulacan, Pampanga, and Bataan, to provide sewerage or sanitation facilities to mitigate pollution of Manila Bay. In compliance, LWUA has submitted a program which entails the participation of the concerned WDs.

We do acknowledge that some of the WDs in the abovesaid provinces have already taken steps to initiate their own respective programs. All the same, LWUA would wish to consolidate collaboration with affected WDs to maximize our joint efforts to address the requirements of the SC.

We are inviting General Managers or his/her representatives of operational WDs in the cited provinces, to take part at the subject Consultative Workshop scheduled for October 4 to 5, 2012 at the LWU A Training Center. Please find enclosed the draft program (CLICK HERE TO VIEW PROGRAM) of the Workshop for your reference.

LWUA will shoulder the costs of the workshop; but participants do have to cover their own respective transportation costs to and from Manila plus lodging costs thereat. The Office of the President (OP) has issued Memorandum Circular No. 30 (please refer to the attached) directing the full implementation of the Philippine Bamboo Industry Development (PBID) Program wherein all Departments and Agencies including Government- Owned and Controlled Corporations (GOCCs), State Universities and Colleges (SUCs) and Local Government Units (LGUS) are enjoined to support the full implementation of the PBID Program.

In this regard, all water districts are enjoined to include bamboo in the list of preferred species for planting and propagation in their National Greening Program (NGP) per OP Memo Circular No. 23, series of 2011 and/or watershed development, protection or rehabilitation projects in coordination with the PBID Council chaired by the Department of Trade and Industry (DTl) and composed among others by the Department of Environment and Natural Resources (DENR) in the pursuit and furtherance of the PBID Program.

MEMORANDUM CIRCULAR No. 007.12

TO: All Water Districts

SUBJECT: Ensuring Quality/Safety of Water Supply During the Rainy Season


In view of the coming rainy season which the authorities in the Philippine
Atmospheric, Geophysical and Astronomical Services Administration (PAGASA) are
predicting to be as intense as the previous years that saw widespread and heavy
floodings in many parts of our country, you are hereby enjoined to take all and every necessary precautions and measures to ensure the safety of your water sources and the quality/potability of the water you supply to your concessionaires.

You are also hereby reminded of your obligations to comply with the Philippine National Standards for Drinking Water Supply by treating your water to make sure that it is free from any form of pathogens and other harmful contaminations/substances from source to the service lines and by periodically subjecting the same to physical, bacteriological and other reglamentary tests for verifications.

You are further enjoined to promote water safety consciousness among your concessionaires starting in their own homes and the places that they are regularly going to (school, office, malls) and to encourage their participation in your overall water safety program by reporting illegal encroachments in your water source and watershed areas, illegal connections, and breaks and leakages in the transmission and distribution lines and in their own household service lines after the meter stand.

MEMO CIRCULAR NO. 004.11

TO : All Water Districts

SUBJECT : Implication of Executive Order No. 24 to the Grant of the Year-End
Financial Assistance and P5,000.00 Cash Gift for CY 2010 to Members of Water District Board of Directors


DATE : 15 February 2011


Executive Order No; 24, issued by the Office of the President on 10 February
2011, under Section 5, thereof, provides:

"Section 5. Local Water Districts -- Members of the Board of'
Directors/Trustees of Local Water Districts shali likewise be subject to the policies and principles set forth herein. Separate rules pertaining to classification and compensation of members of the Board of Directors/Trustees of Local Water Districts shall be issued for the purpose."

It will be noted that the undersigned had issued Memorandum Circular No. 015-10, dated 07 December 2010 to all Water Districts relative to the suspension of the grant of the Year-End Financial Assistance and P5,000.00 Cash Gift to the Members of the WD Board of Directors, pursuant to Executive Order No. 7, dated 08 September 2010. The suspension was further extended until January 31, 2011 pursuant to Executive Order No. 19, dated 30 December 2010.

The grant of the Year-End Financial Assistance and the P5,000.00 Cash Gift for CY 2010 to the members of the WD Board of Directors is not without any legal basis. LWUA authorized such benefit pursuant to R.A. No. 9286, amending Sec. 13 of P.D. 198, as amended, which states:

"Section 13. Compensation. - Each director shell receive per
diem to be determined by the Board, for each meeting of the Board actually attended by him, but no director shall receive per diems in any
given month in excess of the equivalent of the total per diem of four meetings in any given month.

Any per diem in excess of One Hundred Fifty Pesos (P150.00) shall be subject to the approval of the Administration. In addition thereto, each director shall receive allowances and benefits as the Board may prescribe, subject to the approval of the Administration."

In view of the explicit pronouncement under Section 5 of E.O. No. 24 that
"separate rules" shall be issued for the purpose, and in the meantime that such rules are not yet in place, it is therefore implied that the CY 2010 Year-End Financial Assistance and the P5,000.00 cash gift, authorized pursuant to LWUA Board Resolution No. 239, s. 2005, implementing R.A. No. 9286 may now be released.

MEMORANDUM CIRCULAR NO. 001-11

TO: ALL WATER DISTRICTS

SUBJECT: CLASSIFICATION OF COMMERCIAL CONNECTIONS

This is to uphold Chapter III Section 4 on the Classification of Service Connections of the LWUA Water Rates and Related Practices Manual (p.11) which classifies Government institutions as residential connection with a Conversion Factor of 1.0 (base rate) as currently adopted by LWUA in its approval of water rates.

Any other Section or provision in the Manual that may be construed to reclassify government institutions otherwisde is therefore negated.

MEMORANDUM CIRCULAR NO. 014-10

TO: ALL WATER DISTRICTS

SUBJECT: PERFORMANCE AUDIT OF WATER METERS


There is a need for Water Districts to reduce the Non-Revenue Water (NRW) in
order to enhance its operational efficiency and improve its financial viability.

All Water Districts are therefore enjoined to periodically conduct performance
audit of water meters being used by customers to ensure its accuracy.

Depending on the condition of operation, the water meters should be tested for its accuracy after five (5) years of utilization. Water meters showing errors of more than the following tolerance levels should be calibrated or replaced.

From Maximum Flow to Transitional Flow: ± 2%
From Minimum Flow to Transitional Flow: ± 5%

In view of the foregoing, all Water Districts are encouraged to allocate funds to
establish their own water meter testing facility.

SUBJECT: Suspension of Year-End Financial Assistance and P5,000.00 Cash Gift to Incumbent Members of Water District Board of Directors

Please be advised that the grant of Year-end Financial Assistance and P5,000.00 Cash Gift to incumbent members of the Water District Board of Directors, authorized under LWUA Board Resolution No. 239, s. 2005, is presently suspended in view of the issuance by His Excellency President Benigno S. Aquino III of Executive Order No. 7, dated 08 September 2010, Section 10 of which, states:

"Section 10: Suspension of All Allowances, Bonuses and Incentives for Members of the Board of Diretors/Trustees. - The grant of allowances, bonuses, incentives, and other perks to members of the board of directors/trustees of GOCCs and GFIs, except reasonable per diems, is hereby suspended until December 31, 2010, pending the issuance of new policies and guidelines on the compensation of these board members."

MEMORANDUM CIRCULAR NO. 009-10

TO: ALL WATER DISTRICTS

SUBJECT: Directive Prohibiting the Association of the President's Name and Image in Government Programs and Projects

The Office of the President has issued a Memorandum dated 05 August 2010 directing all Heads of Government-Owned and-Controlled Corporations "to refrain from associating the President's personality and identity in their program and projects". Consequently, "tarpaulins, billboards and other propaganda materials bearing the President's name and image" shall not be put up for display to announce ongoing or completed programs and projects.

All WD Boards of Directors and WD General Managers shall therefore be expected to strictly implement the President's instructions, coursed through Secretary Julia Andrea R. Abad of the Presidential Management Staff.
